Local Property Management in Marbella: Protecting Your Costa del Sol Investment

As the founder of costadelsolhabitat.com, I have spent years helping international owners navigate the rewarding but legally complex world of property ownership across the Costa del Sol Occidental. Marbella is the jewel of this coastline, backed by the dramatic La Concha peak and the Sierra Blanca massif (the foothills of the Sierra de las Nieves national park) dropping down to 27 kilometres of Mediterranean coastline.

Marbella is not a volume market; it is a premium, villa-led luxury destination. According to the municipal padrón (31 December 2024), Marbella’s population stands at 166,999 (with the official INE figure from 1 January 2024 at approximately 159,000). What makes our municipality truly unique is its vibrant, cosmopolitan fabric: roughly 33% of our residents are foreign-born (52,173 residents born abroad per the 2024 padrón), representing 153 registered nationalities. While British owners remain long-dominant, we manage properties for a diverse high-net-worth demographic including Scandinavian (Swedish, Norwegian, and Danish), German, Belgian, Dutch, Russian, Ukrainian, and Colombian owners, alongside a growing segment of Middle Eastern and Latin American investors.

Whether you own a frontline beach villa in Las Chapas, a luxury apartment in Puerto Banús, a golf-side retreat in Nueva Andalucía (the famous Valle del Golf, including Los Naranjos and Aloha), or an exclusive estate in Sierra Blanca or Nagüeles, managing a home here from abroad requires deep local expertise. From navigating the town's complex planning laws to combatting the corrosive coastal air, here is what you need to know to keep your Marbella property secure, compliant, and profitable.

The Reality of Marbella Planning Laws and Building Permits

If you plan to renovate your Marbella home, understanding the local planning landscape is critical. Marbella’s urban planning has a complex history: the 2010 PGOU (General Plan) was annulled by the Spanish Supreme Court in a series of rulings starting on 27 October 2015, which instantly restored the old 1986 PGOU as the governing plan. While a new PGOM (Plan General de Ordenación Municipal) received a favourable report from the Junta de Andalucía in February 2026 and awaits final plenary approval, the planning status of many plots remains legally uncertain, affecting an estimated 18,000 properties across the municipality.

Before undertaking any works, we must verify your property's status against the 1986 PGOU and check for any protected-zone overlays, which are common in areas like Sierra Blanca or Las Chapas. Furthermore, if your property is located near the beach in San Pedro de Alcántara or Elviria, works may fall under the Ley de Costas (Coastal Law), which imposes a strict "servidumbre de protección" (protection easement) setback of between 20 and 100 metres from the public maritime-terrestrial domain.

When it comes to securing permits from the Ayuntamiento de Marbella, do not make the mistake of assuming minor aesthetic upgrades are simple. Marbella municipal ordinances explicitly exclude terrace glazing or enclosures (acristalamiento/glass curtains) and any volume expansion from the "declaración responsable" (the fast-track notification process). These modifications require a full municipal licence for major works (obra mayor), not a minor works permit (obra menor).

Additionally, while small pergolas of approximately 5 square metres or less often do not require a formal licence, Marbella has issued a specific interpretive criterion regarding setback and separation distances from property boundaries that must be strictly respected.

Finally, if your property is part of a community of owners (comunidad de propietarios), the Ley de Propiedad Horizontal dictates that any change affecting common elements—including the building's façade, structural elements, railings, or even awnings visible from the street—requires formal community approval, typically requiring a three-fifths qualified majority vote.

Premium Maintenance: Combatting "Salitre" and Managing Luxury Features

Marbella’s coastal microclimate is highly desirable, but the level of airborne salt (salitre) is exceptionally high. For properties along the Golden Mile corridor linking Marbella centre to Puerto Banús, or those flanking the Río Verde and Río Guadalmina, salt-air corrosion is a constant battle.

High-net-worth buyers in Sierra Blanca, Nagüeles, and Nueva Andalucía demand high-spec outdoor living spaces. This includes bioclimatic pergolas, glass curtains, outdoor kitchens, and infinity-pool surrounds. To protect these investments, we implement strict preventative maintenance protocols:

  • Corrosion-Resistant Finishes: We ensure all outdoor metalwork, light fixtures, and kitchen appliances are marine-grade stainless steel (316 grade) or treated with specialized anti-corrosive coatings.
  • Bioclimatic Pergolas and Glass Curtains: Motorized systems must be regularly lubricated and sensors calibrated to withstand both the winter humidity and the intense summer heat.
  • Pool and Water Feature Care: Infinity pools require precise chemical balancing to prevent scale buildup on exposed stone borders, alongside regular pump and filtration checks.

Holiday Rental Management and Andalusian Tourism Compliance

If you wish to generate short-term rental income from your Marbella property, you must comply with the regional regulations of the Junta de Andalucía. This requires registering your property with the Registro de Turismo de Andalucía to obtain a VFT (Vivienda de Fines Turísticos) licence.

To obtain and maintain this licence, your property must meet strict criteria, including:

  • Air conditioning in all bedrooms and living areas (if rented during summer months) and heating (if rented in winter).
  • Direct ventilation to the outside or patios.
  • A fully equipped first-aid kit and official complaint forms (Hojas de Reclamaciones) clearly displayed.
  • Strict occupancy limits based on the property's habitability licence.

As your local property manager, we handle the guest check-ins, verify guest identities to submit police reports (Guardia Civil/Policía Nacional) within 24 hours of arrival, and coordinate professional cleaning and linen services to meet the high standards expected by luxury travellers in Marbella.

Keyholding, Home-Watch, and Long-Term Lettings

For absentee owners who keep their Marbella property exclusively for personal use, our professional keyholding and home-watch service provides peace of mind. We conduct regular inspections of your villa or apartment, checking for water leaks, dampness (a common issue during the humid winter months), pest infestations, and security vulnerabilities. We run the taps to prevent dry traps and sewer gases, check the electrical panel, and ensure your garden and pool maintenance contractors are performing to standard.

Should you prefer the stability of long-term letting, we manage the entire process under the Spanish Urban Leases Act (LAU). This includes tenant vetting—essential for protecting your asset—rent collection, deposit management with the regional authority (AVRA), and acting as the sole point of contact for any maintenance emergencies.

Owning a luxury home on the Costa del Sol should be a source of pleasure, not administrative stress. By partnering with a bilingual, locally rooted property manager who understands the Ayuntamiento de Marbella's specific ordinances, the realities of the 1986 PGOU, and the unique maintenance demands of our coastal environment, you ensure your Mediterranean investment remains protected for years to come.
